1.0 Definitions: In this document capitalized words have the following meanings:
Charity" means Hockey New Brunswick
“Draw Number” means a unique multi-digit of number which represent a single entry in the Raffle;
“Participant’ includes a real person who purchases a Ticket, attempts to purchase a Ticket, receives a free Ticket, finds a Ticket, or attempts to redeem a Ticket as a winning Ticket to claim a Prize;
“Prize” has the meaning set out in Section 6.0;
“Official Rules” means this document as may be amended;
“Raffle” means an electronic 50/50 raffle (online and/or in-venue) being offered by the Charity;
“Ticket” means a document (paper or electronic) which records one or more Draw Numbers in the possession of the Participant which allow the Participant to participate in a particular Raffle.
“Winner’ means the Participant(s) who complied with all the requirements in these Official Rules and who holds a ticket with the winning Ticket Number;

2.0 Official Rules: A Participant by choosing to participate in a Raffle agree to be irrevocably be bound by these Official Rules and by the decisions of the Charity, which shall be binding and final as to all matters related to each Raffle.

3.0 Raffles:

3.1 Raffles will be conducted by Charity at the following times, prices and places. The Charity reserves the right to not conduct a Raffle. The Charity reserves the right to modify the conclusion of the Raffle for any reason and at any time with or without notice, including to close the Raffle early. 

Tickets prices are:

$10.00 for 1 raffle number

$20.00 for 40 raffle numbers

$30.00 for 90 raffle numbers

$50.00 for 250 raffle numbers

Early Bird Draws:

The Charity reserves the right to not conduct a Raffle. The Charity reserves the right to modify the conclusion of the Raffle for any reason and at any time with or without notice, including to close the Raffle early.

3.2 Each Ticket is the receipt for the Participant and represents one or more Draw Numbers, each of which is entered into the Raffle. Draw Numbers are not eligible for entry into past or future Raffles. There is no limit to the number of Draw Numbers an entrant may purchase for a Raffle, subject to availability. Raffle Tickets are not transferrable. All sales of Tickets are final and no refunds shall be made under any circumstance. Raffle Ticket purchases are not donations and are not tax deductible.

4.0 Eligibility: At the time of entry, the Raffle is open to real persons who are eighteen (18) years of age or older and can provide valid government-issued identification upon request. Raffle is void where prohibited by law, rule or regulation. All federal, state, provincial and local laws and regulations apply.

5.0 Excluded Individuals. Hockey New Brunswick employees and family members that reside at the same address are not eligible to participate in the raffle draw.

6.0 Prize:

6.1 For each Raffle there will be a grand prize which will be one-half (or fifty percent (50%)) of the gross proceeds collected from the sale of the Raffle tickets for that game (the “Prize”). The remaining one-half (or fifty percent (50%)) of the gross proceeds collected from the sale of Raffle tickets that are not distributed as a Prize will be used to benefit or support the charitable purposes of the Charity, and/or pay expenses related to the operation of the Raffle, as permitted by applicable law.

6.2 In addition to the grand Prize, the Charity may in its discretion offer additional secondary prizes for goods, cash or services which is not linked to the gross proceeds of the Raffle (e.g.: early bird prize(s)).

7.0 Random Drawing: Every transaction is electronically tallied. For each Raffle, the potential winner of the grand Prize and each secondary prize (if any) will be selected by random drawing from among all eligible Draw Numbers received during the applicable entry period in accordance with applicable law. There will be one (1) potential winner chosen for each Prize. The potential winner does not need to be present to claim the prize. If for some unforeseen reason (e.g., weather delay, power outage, emergency, or other reasonably unforeseen event) the Raffle is not completed at the scheduled time, the selection of the winning Draw Number will be completed the first business day that normal business operations resume, and a notice of the winning draw number will be posted on the Charity’s website at www.hockeycanada5050.ca.

8.0 Winner Notification: The winning number will be posted online at within forty-eight (48) hours after the Raffle winner has been selected and the Raffle has concluded. If the Raffle has an in-venue component or is in-venue sales only, the winning Draw Number(s) will be announced The Charity will not contact the winning Draw Number holder(s) directly . In the event of a discrepancy between the actual Draw Number drawn and the announced Draw Number, the actual Draw Number drawn will be considered the valid winning ticket.

9.0 Claiming of Prizes:

9.1 All Prizes must be claimed at the following location by the potential winner: sent electronically

9.2 Any transportation or other expenses required for a potential winner to attend at identified location to claim a Prize will be the potential Prize winner's sole responsibility and will not be furnished, reimbursed or paid for by the Charity.

9.3 All potential winners will have up to 60 days following the conclusion of the applicable draw date to claim the Prize. The purchased Raffle Ticket is the only valid receipt to claim a Prize. The original Raffle Ticket must be presented and reflect the winning Draw Number for the applicable Raffle. A photocopy, photograph or reproduction of the receipt will not be accepted. The Prize may only be claimed by one (1) person . In the event more than one (1) person attempts to claim the Prize, the person who purchased the Raffle Ticket with the winning Draw Number shall be deemed the winner or if identification of such person cannot be confirmed, the Charity may, in its discretion, require all persons attempting to claim the Prize to identify which person was the person who purchased the Raffle Ticket or may disqualify all persons attempting to claim the Prize. A person presenting a winning Raffle Ticket will be required to present valid government issued identification and complete an Affidavit of Eligibility and Release.

9.4 Following verification of eligibility and the completion of all required documentation, the Charity will mail a check to the winner within approximately six (6) weeks of the date of completion of all required paperwork. No cash payments will be made to any winner.

9.5 Each winner will be subject to federal, state, provincial and local rules and regulations regarding gambling winnings, including those of tax governing and/or enforcement agencies that the Charity is required to comply with reporting requirements on Prize amounts imposed by state, local, provincial and/or federal laws, as applicable, and each winner acknowledges that the Charity may, as necessary, collect some or all tax withholdings from the Prize prior to distribution to the winner. Each Winner assumes all responsibility for any state, local, provincial or federal taxes, fees or other government assessments on the Prize amount. Each winner is advised to consult the winner's own tax advisor(s) with respect to the liabilities that may arise from entering the Raffle and winning the Prize.

9.6 If the potential winner fails to claim a Prize in the time period above, is determined to be ineligible, fails to submit identification or the required documents within the specified time period, or otherwise fails to comply with these Official Rules all as determined by the Charity in its sole discretion, the potential winner will be disqualified, the Prize will be forfeited and the Prize will be retained by the Charity. Winners may also choose to waive their right to receive the Prize, at which time the Prize from that Raffle will be forfeited and the Prize will be retained by the Charity.

10.0 Prize Restrictions and Odds: A Prize is not transferable or assignable and cannot be substituted for another prize. Any and all taxes, fees, and other costs including but not limited to federal and, if applicable, state, provincial and local income and withholding taxes that may arise and be due or asserted on the value of the Prize are the sole responsibility of each Winner. Odds of winning depend on the number of eligible entries received for the applicable Raffle.

11.0 Publicity Release: Each Raffle Winner agrees that acceptance of a Prize grants to the Charity the right to print, publish, broadcast, and use world-wide, in any media now known or later developed at any time or times, such Raffle Winner's name, portrait, picture, voice, likeness, and biographical information for any purpose, including but not limited to in advertisements, publicity, and other communications without additional compensation, except where prohibited by law.

12.0 Release of Liability:

12.1 The Charity and any affiliates, which includes any parent or subsidiary company, and respective shareholders, employees, directors, officers, representatives, agents, successors, and assigns, as well as the supplier of the raffle system used to conduct the Raffle (the “Released Parties”), are not responsible to the Participants for (1) entries which are stolen, lost, damaged, illegible, given away or no longer in the Participant's possession, (2) entries that have been or may have been tampered with or re-sold in violation of these Official Rules; (3) entries or payments that are delayed, misdirected, undelivered, not fully captured, or garbled; (4) any other errors of any kind, whether human, typographical, printing, mechanical, or electronic in nature, which relate to or are connected with the Raffle (collectively, as described in clauses (1) through (4), "Errors"), including without limitation Errors in Raffle-related materials or in the administration of the Raffle, such as Errors in processing entries, identifying potential winners, determining the Winners, or announcing or delivering a Prize.

12.2 Each Participant agrees to release, indemnify, defend and hold harmless the Released Parties against any and all liability, claims, actions, losses, damages, lawsuits, costs and expenses (including, without limitation, reasonable attorneys' fees) of any kind whatsoever arising directly or indirectly for injuries (including death), damages or losses to persons and property, which may be sustained in connection with the Raffle, participation in the Raffle, attempt to participate in the Raffle, receipt or use of any Prize, or while preparing for, participating, in, and/or traveling to any Prize-related activity.

13.0 Amendment of Official Rules. The Charity reserves the right, in its sole discretion, to terminate, modify, or suspend any Raffles should the Charity determine, in its sole discretion, that any virus, bug, non-authorized human intervention or other causes have corrupted or affected the administration, security, fairness or proper conduct of the Raffle. In such case, the winning number will be selected from among all eligible entries received prior to the aforesaid action taken by the organization. The decision of the Charity with respect to each Raffle is final and binding.

14.0 Correction of Errors: The Charity reserves the right to correct, typographical, clerical or printing errors in any Raffle-related materials, including these Official Rules. Released Parties are not responsible or liable for any events beyond the control of the Charity which may cause the Raffle to be stopped, including but not limited to any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction or unauthorized access to, or alteration of, entries, nor are the Released Parties responsible for any failure of any ticket to be delivered on account of technical problems or human error, or any combination thereof.

15.0 Disqualification of Participants. The Charity may exclude, disqualify or terminate participation in the Raffle to any Participant who, in its sole discretion: (a) ignores these Official Rules; (b) acts in a manner the Charity determines to be not fair; (c) acts with an intent to annoy, threaten or harass any other entrant or the Charity; (d) acts in any other disruptive manner; or (e) tampers with the entry process. The Charity will not replace any lost, mutilated, or stolen Tickets. The Charity reserves the right to make changes in the rules of the Raffle, which changes will become effective upon publication of revised Official Rules at Hockey New Brunswick's 50/50 page.

16.0 Limitation of Liability: A Participant’s sole and exclusive remedy for any Released Parties’ breach of duty or conduct related to the Raffle shall be limited to the return of the purchase price paid for his or her Raffle ticket(s), or where no such price was paid, the sum of $1.00. In no event shall any Released Party be liable to any Participant for any incidental, special, punitive, or consequential damages of any person or entity whether arising in contract, tort or otherwise, arising out of a Raffle.

17.0 Governing Law and Dispute Resolution: Except where prohibited by law, each Participant agrees that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of entrants, the potential winners and the Charity in connection with any Raffle, shall be governed by, and construed in accordance with, the laws of NB, without giving effect to any choice of law or conflict of law rules or provisions that might otherwise cause the application of the laws of any jurisdiction other than the New Brunswick. Any action seeking legal or equitable relief arising out of or relating to any Raffle or these Official Rules shall be brought only in the courts of the province of NB. All causes of action arising out of or connected with the Raffle or any Prizes awarded shall be resolved individually, without resort to any form of class action. All claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees and costs. The Participants hereby agree all matters will be heard by judge alone and hereby waive the right to trial by jury.
